This has been out for at least a week now, but I thought that I'd share it with anyone here who hadn't heard about it yet.

MediaDefender, a company contracted by the MPAA and RIAA to help curb online piracy, has suffered a humiliating breach of information security. It seems that an employee forwarded all of his company e-mails to a gMail account, which was then accessed by a group called the MediaDefender-Defenders. So, now there is a 700MB file containing hundreds of sensitive internal e-mails floating around the internet, especially on BitTorrent, one of the very networks the MediaDefender was regularly attacking.

Democracy (aka, Republicanism), by definition, is the rule of the majority. Does, then, democracy protect the minority from the majority?

In the United States, at least idealistically, the minority is protected from the majority insofar as their rights are concerned. For example, in the US no laws can be made which would forbid certain types of speech, no matter how offensive to the majority they may be. (See, for example, The National Socialists vs, The Village of Skokie). Does this mean that the US is not, at least by strict definition, a Democracy?

So, do/should democracies protect minorities?

The question is:

Does sovereignty ultimately lie with the populace or does it ultimately lie with those who exercise it (government)?


More on the Question:

Many people believe, and I don't necessarily disagree with them, that the ultimate authority and right to rule (sovereignty) is the exclusive and non-transferable domain of those who would be governed. This is the supposed basis of all democracies and republics.

But, can it be said that the actual authority lies with those who exercise that authority and that by virtue of exercising the authority, they have the right to do so?

Idealistically, I would agree with the former statement that the people rule. However, realistically I fear that the latter statement may be the case.

What do you all think?
